Official Rules

OKUMA ROD AND/OR REEL PRODUCT PURCHASE NECESSARY TO ENTER OR WIN. PARTICIPATION CONSTITUTES PARTICIPANT’S FULL AND UNCONDITIONAL AGREEMENT TO AND ACCEPTANCE OF THESE OFFICIAL RULES..

I. SUBMISSION PERIOD: The Okuma Registration Giveaway (the “Contest” or “Promotion”) begins on or about 09:00 a.m. November 1, 2019 (“Start Date”) and ends at 11:59:59 p.m. on February 16, 2020 (the “Entry Period”). The Contest is sponsored by, Okuma Fishing New Zealand (the “Sponsor” and “Prize Supplier”). The official clock for purposes of the Contest is the computer of the Sponsor. 

II. ELIGIBILITY: The Contest (“Contest”) is open solely to a resident of New Zealand. To participate in the Contest, contestants must have purchased an Okuma Rod and/or Reel from a New Zealand retailer between the 1 November 2019 and 15 February 2020. Officers, directors and employees of Okuma NZ, its subsidiary and affiliated organizations or companies, advertising, promotional and judging agencies, persons engaged in the development, production or distribution of materials for this Promotion (collectively, the “Released Entities”), and members of the immediate families (defined for these purposes as including parents, grandparents, children, grandchildren, siblings, and each of their respective spouse) or households (whether related or not) of any of the above, are NOT eligible to enter or win. The Contest is subject to all applicable New Zealand laws and regulations. Sponsor and Administrator’s decisions, which are final and binding in all matters related to the Contest. Entry constitutes a Participant’s certification that he/she meets the eligibility requirements set forth in these Rules. Sponsor reserves the right to verify eligibility of any potential winner. Winning a prize is contingent upon fulfilling all requirements set forth herein. Prize winner must be available to complete the fishing trip which will take place on the first weekend of March 2019.

III. HOW TO ENTER: Participants enter by purchasing any Okuma Rod and/or Reel at any New Zealand retailer during the competition period. Participants are then required to register that product online. Once the product has been registered online then you go in the draw. Each Okuma product Gains you one entry. Winner must be able to provide receipt or purchased product.

Registration Entry Steps: You must submit your registration between 1/11/19 (9 AM) thru 16/02/20 (11:59 PM). Registration received after the Submission Period are automatically disqualified.  

Registration Entry Steps: 

1. Purchase any Okuma Rod/Reel at any New Zealand Retailer  
2. Go to www.okuma.co.nz and click the top banner to register your product
3. Enter your details, Purchase date, Store and add the Okuma products you are registering. You can add more than one product just press the blue ‘Add item’ button
4. On the registration page it will ask for model and serial number. On the reels the model is the name on the side or front of reel and serial number is located on the foot of the real looking like ‘4228 or 4010-013’. Rods the model will be located between the top of the grip and the first guide on the rod looking like ‘OKROTC702DSH’. No serial number is required
5. Make sure to review the terms and conditions before checking the box
6. Click “Register” to submit your photo or video entry
7. Keep your receipt as you will need this to claim the prize if you win

 

VII. CONTEST WINNER DETERMINATION:  Each product submission will be entered and the winner will be picked using a computer based random generator. The Winners will be notified by email on or about the week of 17 February 2020. The Judges’ decisions are final and binding in all matters relating to this Contest.

VIII. PRIZE: One (1) Grand Prize Winner will be awarded a 2-nights and 3-days stay in a accommodation decided by Sponsor, round trip travel from Auckland for two (2), 2 days of fishing with Scott and Mig from Fishing & Adventure Plus $1000 worth of Okuma fishing gear. All other food, travel costs will be included on location. Sponsor will provide fishing tackle and necessary equipment.

IX. GRAND PRIZE CONDTIONS:  While the Prize Supplier will make every effort to confirm reservations as requested, operational and/or market conditions may prevent them from doing so on your requested dates. Accommodations are subject to capacity controls, availability, blackout dates and other restrictions, all of which are subject to change at Sponsor’s sole discretion. Grand prize will have to be redeemed on the 7/03/2020. If no suitable dates can be found, a prize of a $2000 gift to be spent on Okuma products will be substituted. Prizes are not transferable, or redeemable for cash.

There are no substitutions unless specified by the Sponsor. Prize details and availability are subject to change, and in the event that Sponsor is unable to provide the Winner with the Prize won, the Sponsor may elect, at the Sponsor’s sole and absolute discretion, to provide Winner an alternate prize. The stated ERV of the Prize is based on available information provided to Sponsor at the time these Official Rules were drafted and the value of the Prize awarded to a Winner will be reported for tax purposes as required by law. An unclaimed Prize will be forfeited. A properly claimed Prize will be awarded. The Sponsor and its agents are not in any way responsible or liable for damages resulting from shipping and handling, loss, use or misuse of any Prize awarded in this Contest. All decisions by Sponsor as to Winner and the Prize are final.

All expenses not specifically mentioned herein, are not included as part of the What Inspires You? Contest Prize, and are solely the Grand Prize Winner’s responsibility, including, but not limited to: travel insurance, room service, bag check fees, parking fees, laundry service, food, alcoholic beverages, merchandise, souvenirs, telephone calls, gratuities and service charges, site-seeing excursions and any other incidental costs or expenses not identified in these Official Rules. Sponsor is not liable for, and no refund or compensation will be made in the event of a cancellation, except at the sole and absolute discretion of Sponsor. Travel companions must execute a liability/publicity waiver (“Companion Waiver”) prior to issuance of Prize documents. If a travel companion is a minor, the parent or legal guardian must sign and return the Companion Waiver and accompany the minor on the What Inspires You? Contest Prize.
If the Winner becomes disabled or cannot otherwise fully enjoy the What Inspires You? Contest Prize due to illness, Sponsor shall have the option of: (a) being relieved of liability for fulfillment of the prize award; or (b) at Sponsor’s sole and absolute discretion, extend the period during which the Prize may be awarded for a period equal to the duration of the Prize Winner’s disability or illness, in which case certain Prize components may not be available. The Winner must prove such disability by a doctor’s certificate, which certificate shall be endorsed by another physician agreeable to Sponsor and Winner. 

X. GENERAL PRIZE TERMS AND CONDITIONS: The Grand Prize Winner is required to comply with any and all applicable National and local laws, rules and regulations. The stated “ERV” of the Prize is based on available information provided to Sponsor at the time these Official Rules were drafted (and any difference in ERV at the time of awarding will not be awarded) and the value of any Prize awarded to the Winner may be reported for tax purposes as required by law. The Winner will be solely responsible for all federal, state and/or local taxes, and for any other fees or costs associated with the Prize they receive.

XI. LIMITATIONS OF LIABILITY: If this Contest is not capable of running as planned for any reason, including, less than 20 entrants or, without limitation, due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Sponsor which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Contest, the Sponsor reserves the right, in its sole discretion, to disqualify any individual who tampers with the entry process, and to terminate, modify or suspend the Contest, in whole or in part, at any time, without notice and award the prizes using all non-suspect eligible entries received as of or after (if applicable) this termination or suspension date. Any person who supplies false information, obtains entries by fraudulent means or is otherwise determined to be in violation of these Official Rules in an attempt to obtain any prize will forfeit any prize won and may be prosecuted to the full extent of the law. Released Entities assume no responsibility for any incomplete, incorrect, or inaccurate information, whether caused by Website users, tampering, hacking, or by any of the equipment or programming associated with or utilized in the Contest or by any technical or human error. Released Entities assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. The Released Entities are not responsible for any problems or technical malfunction of any telephone network or telephone lines, computer on-line systems, servers, or providers, computer equipment, software, failure of any e-mail or entry to be received by Sponsor on account of technical problems, human error or traffic congestion on the Internet or at any Website, or any combination thereof, including any injury or damage to entrant’s or any other person’s computer (or any information/material stored therein) relating to or resulting from participation in this Contest or downloading any materials in this Contest. CAUTION: ANY ATTEMPT TO DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY SUCH PERSON(S) RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW. In the event of a dispute as to the identity of a winner based on an e-mail address, the winning entry will be declared made by the authorized account holder of the e-mail address submitted at time of entry. “Authorized account holder” is defined as the natural person who is assigned to an e-mail address by an Internet access provider, on-line service provider or other organization (e.g., business, educational, institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. 

XII. USE OF PERSONAL INFORMATION/OPT IN: By entering via the Sponsor’s application page, you consent for the Sponsor to obtain, use, and transfer your name, address and other information for the purpose of administering this Contest; the information that you provide in connection with the entry process will be used by Sponsor only, and will not be sold or provided to another company. You are authorizing the Sponsor to send you e-mails to the address entered on entry form, regarding products and services. You may opt out of receiving future e-mails from Sponsor by clicking on the link contained in the most recent e-mail received. You will remain eligible for this Contest whether or not you opt out of receiving promotional e-mails from the Sponsor.

XIII. RELEASES: All Participants, as a condition of participation in this Contest, agree to indemnify, release and hold harmless Sponsor and Released Entities from and against any and all liability, claims, damages, injuries or actions of any kind whatsoever for injuries, damages, or losses to persons or property which may be sustained in connection with: (a) accessing the Sponsor’s Website; (b) participating in any aspect of the Contest, including, without limitation, while preparing for, participating in and/or traveling to or from any Prize or Contest-related activity, including, without limitation, any injury, damage, death, loss or accident to person or property; (c) the receipt, ownership, possession, use or misuse of any Prize awarded; (d) viruses or any downloading or other problems with the Contest Application, or; (e) any typographical or other error in these Official Rules or the announcement of offering of any Prize. Prize Winner bears all risk of loss or damage to his/her respective Prize after it has been delivered. 

XIV. GOVERNING LAW/DISPUTES: By participating in the Contest, Participants agree to be bound by the Official Rules, Sponsor’s Web Site Terms of Use (if any and if applicable to Participant’s method of participating), and the decisions of the Sponsor and Administrator, which are final and binding in all respects. Except where prohibited, Participant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Contest or any prize awarded shall be resolved individually, without resort to any form of class action, and any judicial proceeding shall take place (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Contest, but in no event legal fees; and (3) under no circumstances may Participant obtain awards for, and Participant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the Participants, Sponsor, or the Released Entities in connection with the Contest, shall be governed by, and construed in accordance with, the laws of New Zealand..

XVI. ADMINISTRATOR: Composite Developments NZ (Okuma New Zealand), 29 Canaveral Drive, Auckland (the “Administrator”).

XVII. MISCELLANEOUS: The names of individuals, groups, companies, products and services mentioned herein, and any corresponding likenesses, logos and images thereof reproduced herein, have been used for identification purposes only and may be the copyrighted properties and trademarks of their respective owners. The mention of any individual, group or company, or the inclusion of a product or service as a prize, does not imply any association with or endorsement by such individual, group or company or the manufacturer or distributor of such product or service and, except as otherwise indicated, no association or endorsement is intended or should be inferred. The invalidity or unenforceability of any provision of these Official Rules or the Prize Acceptance Release will not affect the validity or enforceability of any other provision. In the event that any provision of the Official Rules or the Prize Acceptance Release is determined to be invalid or otherwise unenforceable or illegal, the other provisions will remain in effect and will be construed in accordance with their terms as if the invalid or illegal provision were not contained herein. Sponsor’s failure to enforce any term of these Official Rules will not constitute a waiver of that provision. For Entrant, to the extent there is a conflict between Official Rules appearing any other location and any terms of use or other agreements posted on the Sponsor’s Web Site, these are the Official Rules to be abided by.
